Returns policy

Returns and Refunds for Personalized Products

Personalized products are typically final sale. But 'no refunds ever' is a chargeback magnet. Here's a policy that protects you AND satisfies customers.

The default rule: personalized = final sale

Legally, personalized products (name necklace, custom photo mug) qualify as bespoke goods excluded from EU 14-day right of withdrawal + most US state buyer's-remorse laws. You can enforce final sale on personalization.

Exceptions you should honor

Policy template (drop-in)

Returns Policy for Personalized Products

Personalized items (with custom text, photo, or design) are made to order and cannot be returned or refunded unless defective or damaged in transit.

If your product arrives defective or damaged, contact us within 7 days of delivery with photos. We will replace at no cost.

If you notice a typo or error in the personalization you approved, we cannot refund but will offer a reprint at 50% of retail as courtesy.

Standard (non-personalized) items follow our regular 30-day return policy.

Chargeback prevention

Communicating the policy at product page

Show 'Made to order — no returns except for defects' near the Add-to-Cart button. Not buried in footer. Reduces buyer's remorse chargebacks.

Frequently asked questions

Can customers return personalized products on Shopify?

Legally no in most jurisdictions — personalized items are bespoke goods excluded from standard return rights. But honor exceptions for defects, merchant errors, damage in transit.

How should I set a returns policy for custom items?

Final sale default, with exceptions for defect / merchant error / transit damage. Explicit language in policy page + at product page + in confirmation email. Terms acceptance at checkout.

Are personalized items eligible for refunds under EU law?

Bespoke/personalized goods are excluded from the 14-day right of withdrawal under EU Directive 2011/83/EU. Refund only for defects.

What if a customer claims copyright on an uploaded design?

Require customer to prove ownership (send DMCA counter-notice or C&D). If uncertain, cease sales of that customization + offer refund to reduce risk.

How to handle a customer dispute over a custom design?

Show them their approved personalization + order timestamp. If it matches, no refund. If merchant error, replace at your cost. Document everything for chargeback defense.

Do I need a waiver for customer-submitted artwork?

Yes. Terms checkbox at add-to-cart: 'I confirm I own the rights and indemnify [store] against any copyright claims.' Reduces your legal exposure.

Shopify legal requirements for user-generated content?

Comply with DMCA (US), copyright frameworks in your jurisdictions, and GDPR (EU) for personal data (photos). Publish policy pages, register DMCA agent.

How do I comply with GDPR when storing customer designs?

Disclose in privacy policy: what data collected, retention period (default 90 days post-fulfillment), right to deletion, POD partner as data processor.

Tips for clear policy language on personalized goods?

Plain English, avoid legalese. Use bullet points. Show the policy at product page, not just footer. Reference specific exceptions ('except for defects').

Can I use 'non-returnable' tags on Shopify products?

Yes. Add a product tag 'non-returnable' or 'made-to-order'. Filter your Shopify Returns app to exclude these from self-service returns.
